Plain English, on purpose. These Terms are the agreement between you and us about how Subliminally may be used — what you get, what you owe, and what we don't promise. Please read the wellness disclaimer in section 9; it's the most important part.
Subliminally by FTHR ("Subliminally," "we," "us," "our") is a wellness and personal-development app from For The Hopeful Romantics (FTHR), operated by Adaku LLC. These Terms of Use ("Terms") govern your use of subliminallybyfthr.com, the Subliminally iOS and Android apps, and everything we offer through them (together, the "Service").
By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is part of this agreement. If you don't agree, please don't use the Service.
You must be at least 18 years old, or the age of majority where you live, to create an account and to subscribe. The Service is not directed at children, and we do not knowingly collect information from anyone under 13. See section 8 of our Privacy Policy.
A free account lets you build personalized subliminals — layering a frequency, ambience, binaural beats and affirmations in your own voice or an AI voice — with sessions up to 20 minutes and up to 2 saved subliminals in your library. We may change what the free tier includes over time.
Subliminally Premium (currently offered as our Ritual plan) is our paid subscription. It unlocks longer sessions, an unlimited library, the gratitude and manifestation journal, the daily log for photographs of your handwritten journal, the habit tracker, EFT tapping sessions, visualization scripting, studio voices and voice cloning.
How your subscription is billed and cancelled depends on where you bought it, and we can only act on the side we control.
Please subscribe in one place. If a web subscription and a store subscription are active on the same account at once, you may be charged twice by two separate billers, and only one of them will be reflected on your account.
Subliminally is a wellness and personal-development tool. It is not medical, psychological, psychiatric, or any other form of professional healthcare treatment, and it is not a substitute for care from a qualified professional.
Nothing in the Service is a diagnosis, a treatment, a therapy, or medical advice. We are not your doctor, therapist, or counselor, and using Subliminally does not create a professional relationship of any kind.
Never disregard professional medical advice, or delay seeking it, because of something you read, heard, or built in Subliminally. Talk to a qualified professional before relying on it if you have a physical or mental health condition, are pregnant, have epilepsy or a seizure disorder, have a hearing condition, or are in treatment of any kind.
If you are in crisis or may be in danger, stop and get real help now. In the U.S., call or text 988 (Suicide & Crisis Lifeline), or call 911. Elsewhere, contact your local emergency number. Subliminally is not a crisis service, is not monitored, and cannot help in an emergency.
Please also use the Service sensibly: don't listen while driving or operating machinery, and keep the volume at a comfortable level, particularly with headphones and for sessions that run overnight.
Subliminally offers practices drawn from wellness, spiritual and self-development traditions. We make no promise, guarantee or representation that any feature will produce any particular result for you — and that includes subliminal audio, manifestation practices, Solfeggio and other frequencies, binaural beats, EFT tapping, visualization, affirmations, journaling, habit tracking, and everything else in the app.
Where the app describes what a frequency or a practice is "for," it is repeating an association from those traditions, not a medical or scientific claim, and not a claim we have tested. Results, if any, differ from person to person. Nothing here is a promise about your health, your finances, your relationships, or anything else in your life.
Don't use the Service to:
We may investigate suspected misuse and may suspend or terminate accounts that violate these Terms.
Everything in the Service that isn't Your Content — the Subliminally and For The Hopeful Romantics names and logos, the app and website, the illustrations and Higher Self artwork, the sound library, the interface, the text, and the underlying software — belongs to us or to our licensors and is protected by copyright, trademark and other laws.
Your subscription is a personal, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. It doesn't transfer any ownership. Don't copy, modify, distribute, sell, lease, or create derivative works from any part of the Service, and don't use our names, logos or artwork without our written permission.
Subliminally depends on outside providers to work: Supabase for accounts, database and file storage; Vercel for hosting; Anthropic for generated text; ElevenLabs for studio voices and voice cloning; Stripe for web payments; RevenueCat together with the Apple App Store and Google Play for app subscriptions; Google for optional sign-in; and Resend for our emails. What each one receives is set out in our Privacy Policy.
These providers have their own terms and privacy policies, which govern their handling of your information. We're not responsible for their services, and an outage or change at a provider may affect features of Subliminally. The Service may also link to third-party sites — including our YouTube library of general subliminals — which we don't control or endorse.
Where you subscribe through the Apple App Store, Apple is not a party to these Terms, is not responsible for the Service, and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You may stop using the Service at any time, cancel your subscription as described in section 8, and delete your account as described in section 4.
We may suspend or terminate your account or access, with or without notice, if you breach these Terms, if we're required to by law, or if we reasonably believe your use puts other people, the Service, or us at risk. We may also discontinue the Service, or any part of it, with reasonable notice where practical.
If we terminate your account for a reason other than your breach of these Terms, and you have paid for a period you can no longer use, we'll refund the unused part of that period where we're the biller. On termination, your right to use the Service ends immediately, and your content may be deleted. Sections 11, 14, 17, 18, 19 and 21 survive the end of this agreement.
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We don't warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that any content or AI output will be accurate or suitable, or — as section 10 says — that the Service will produce any particular result for you. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you.
To the fullest extent permitted by law, Adaku LLC, For The Hopeful Romantics, Subliminally by FTHR, and our officers, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, or content, arising out of or relating to your use of (or inability to use) the Service — whether in contract, tort, or any other theory, and even if we've been advised such damages are possible.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $50 USD.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless Adaku LLC, For The Hopeful Romantics, and Subliminally by FTHR from any claim, loss, liability, or expense (including reasonable legal fees) arising out of Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
We may update these Terms as the Service changes. When we do, we'll update the "Last updated" date at the top, and for material changes we'll make a reasonable effort to let active subscribers know by email or in the app before they take effect. Continuing to use the Service after a change means you accept the updated Terms. If you don't accept them, stop using the Service, cancel, and delete your account.
These Terms are governed by the laws of the state in which Adaku LLC is organized, and the federal laws of the United States, without regard to conflict-of-law principles — except that nothing here deprives you of the protection of mandatory consumer-protection laws where you live. If any provision is found unenforceable, the rest stays in force.
